George Davies, a final year law student, at the West Midlands University, goes on a trip with his friends after completing his final exams to the Lake District. They all stay in a bed and breakfast, but are very dissatisfied with the standard of the accommodation. George leaves a negative review on a popular Cumbrian tourist travel website.
A month later George receives his credit card bill and is shocked to see that the
bed and breakfast has charged a total of 1,000 to his credit card, over and above the cost of the accommodation. When he contacts them to find out what has gone on, they point out the following clause in their terms and conditions, which they confirm he accepted when he made the booking.
a) The customer agrees that he will contact the hotel with any complaints or
concerns he may have in relation to the stay prior to leaving any negative review on
any public websites or other forums, in print or online.
(b) A negative review may only be left if the hotel has been given at least 28 days to
resolve the complaint, and has failed to do so in that period.
(c) The customer agrees that he will be liable to pay the hotel compensation of up to
1,000 for the harm to its reputation and loss of business if he leaves a negative
review in breach of this clause. The customer consents to the hotel collecting this
money through a charge to the payment card provided as security for his booking.
Advise George in relation to the bed and breakfasts action and in relation to
the above clause.
